The present General Sales Conditions are applicable to all sales of Benneton Graveur items made via http://www.bennetongraveur.com online trade site. They are concluded between
Benneton Firm (hereby named the seller) and the buyer (hereby called the customer). The purchase of products on the website www.bennetongraveur.com (hereby named the site) is submitted to these rules. Purchasing is only allowed to people who are over 18 years old and enjoying full legal rights.

These sales terms apply to products ordered online and then delivered in France and abroad, and do not apply to the sales concluded in our shop, 75 boulevard Malesherbes 75008 Paris, or by phone, or by any other way.
When the order is confirmed by the buyer (The customer), the latter accepts all the general sales conditions, prevailing on all preceding terms, and confirms that he has read them prior to ordering.
Benneton Graveur reserves the right to modify the present general sales conditions. The applicable conditions are those mentioned on the website at the date of order.
Only the products shown on the website are for sale online. The pictures of the products are as close as possible to reality but do not have any contractual value. The customer should check the product description in order to know about the main features. We are doing our best to show colors corresponding to reality on the pictures but they may vary when displayed on different screens.
The prices of the items are inclusive of all taxes (TTC). Delivery charges are extra. The VAT (Added Value Tax) is the one applied on the French territory, at the date of order. The price of the items is the one appearing on the site when ordering.
The seller may modify the prices anytime before the order. The customer will be shown, before ordering, a recap detailing the selling price and the delivery charges.
III-1 How to order
The site « http://www.bennetongraveur.com » enables to order from France or from any foreign country a selection of products made or designed by Benneton Graveur in France.
The Customer should, upon completion of his / her first product order, open an account with “Benneton Graveur” and fill an on-line order form, specifying some mandatory information for his/ her selection to be validated by the Company.
III-2 Order processing
The customer should follow the different steps specified on our web site. Any order will be confirmed with an email from Benneton Graveur firm. An order can be sent to one or several addresses in France or abroad.
Any new customer must fill in all the required information, so as to create his / her profile, which will be reachable through the heading « My account ».
The customer must fill in the entry form carefully, giving all required information, including an email address and a confidential and personal password, so that he / she can identify himself / herself on our site easily afterwards.
Any customer who has already created an account, must identify himself after having clicked on « Continue your command », with his e-mail address and his password.
The customer agrees with giving these two identifiers as a proof of his / her identity. The required information marked with an asterisk is compulsory. These data are major for treating delivery and they are utterly confidential.
The customer chooses the product or the different product of his/her choice, clicks on « Add to my cart ».
At any time, the customer may:

The validation of the recap order form sets up the customer's acceptance. This acceptance equals a signature and is the proof of the conclusion of the agreement between both parts and of the amount of money which is due when performing the order.
The order form is recorded in the Benneton Graveur database, kept on a reliable and a sustainable support. The customer accepts the order form as a proof of the contract between both parts. The customer will be able to print the order form with the acknowledgment receipt. The order summary will also be accessible in « My account ».
Concerning the made-to-order stationery, the mock-up shown before printing isn't binding. Benneton Graveur tries to give an insight as close as possible to the reality. This is a small-scale production made by craftsmen, so that differences can appear.
Our offers of product and prices are enforced as long as they can be seen on the site, so long as we have them in stock. You may check their availability when ordering items. Mistakes or exceptional changes may occur, especially when several customers are ordering the same item.
If a product would not be available after your order, we will inform you by an e-mail or by phone as soon as possible.
The time of manufacturing our products may vary, notably when made-to-order. In such a case, we will inform you by e-mail or telephone as soon as possible.
Benneton Graveur SARL is not responsible for some products being out of stock or not available anymore, and may change the articles proposed on the site at any time and without warning.
The seller reserves the right to refuse an order in case of:
An invoice is issued for each confirmed and paid order, and then sent to the customer via email.
The secure payment is processed in euros, and debited immediately from a credit card or from the PayPal customer’s account. Benneton Graveur does not receive any information on the customer's account details. The accepted Credit Cards are: Visa, Master Card and American Express.
V-1 Delivery Clauses
In case of different availability dates for the products of an order, the delivery will take place once all products are ready for dispatch.
The delivery is made by the Post Office « La Poste » (Colissimo) or by FedEx services upon customer’s request. The customer should in that case supply his / her FedEx account number or he / she will be charged the FedEx list price.
In case of goods damaged during delivery, the customer should immediately notify it on the forwarder’s documents and inform Benneton Graveur. In case the goods cannot be inspected immediately, the customer should write “goods not checked” on the forwarder’s receipt and then send an eventual claim to the forwarder and to Benneton Graveur within 48 hours from reception.
V-2 Delivery expenses, customs and taxes.
Delivery expenses – in France, DOM - TOM, and foreign countries – are calculated according to the product weight when confirming your order.
Orders shipped to foreign Countries outside European Union, may be subject to import fees, duty, customs, VAT charges or additional taxes when the package arrives.
Benneton Graveur is not responsible, nor can we offer any specific advice on fees or additional taxes that you may be charged when your merchandise arrives. We cannot make refunds to customers who do not receive shipments because they have declined to pay these costs. We recommend that you contact the appropriate government agency of your Country before placing your order and ask for information about these potential charges, so you know in advance what your total charges will be.
According to the French law - article L 121 – 20 of the consumption code – the buyer may apply his / her withdrawal right within 7 days, without any notification of his reasons or any financial penalty.
This time frame, calculated from the product delivery date, enables him / her to cancel the whole or a part of his / her order and send back the product to his / her own expenses.
This possibility does not apply to made-to-order goods.
Benneton Graveur SARL's responsibility concerning the delivered goods is limited to the price of damaged ones, subject to commercial or legal applicable guarantees and any legal right of recourse.
If any litigation occurred, the French version of these general sales conditions only is legal and the Paris trade Tribunal is the only one to have authority.
